POS Solutions sues Tower Systems

POS Solutions has issued proceedings against Tower Systems in the County Court of Victoria.  In the fifteen page writ POS Solutions claims that they are suffering damage including the loss of customers because of posts published at this blog.

  1. Hope they managed to pronounce Tower Systems name correctly, instead of always pronouncing it as Towers, usually accompanied by terrible grammar.

    Let the software and the customer testimonials speak for themselves. Most people have a brain to make up their own minds and shouldn’t need to be swayed by a blog post.

  2. how many customers do they claim have been lost? Have they specified any amount that they seek in compensation?

  3. Poor Bernard must be doing it tuff for a quid since he got back from Europe, either that or he just does not get that he needs to compete for business not just throw his hands in the air and cry while all his customers bail.
    Cheer up Bernard at least you have had a holiday recently, some of us can only dream.

  4. I’ve never read anything here that could be considered as “damaging”. I must have missed something.

    Who would really consider reading blogs before looking into what the actual product has to offer when considering purchasing software?

  5. Amused, the particulars of the claim will come out further down the track in the case. One would expect that the number of customers migrating would be significant for them to mount a case.

  6. Zak, Stacey, Michael and Bernard should take they money they are spending on suing you and invest this in their customer support. Staff are under resourced and not able to get back to users in a reasonable time. Waiting two days for a call back on a serious issue is ridiculous.

  7. I THOUGHT WE ALL HAD A MIND OF OUR OWN TOO CHOOSE WHAT WE THINK WOULD SUIT OUR BUSINESS BEST,MY DECISION WAS MADE ON THIS WITH PLENTY OF HOMEWORK ON BOTH SYSTEMS.
    IT IS NOT A DECISION WHICH IS TAKEN LIGHTLY AS THEIR IS LOTS OF DIFFERENT ELEMENTS TO CONSIDER WHEN DECIDING ON A SYSTEM.
    I AM SURE POS COULD USE THEIR ENERGY TO BETTER USE AND CONCRETRATE ON THEIR OWN BUSINESS

    MY COUSIN MIGRATED TO TOWER FROM POS SOLUTIONS DUE TO INEFFECIENT SYSTEMS NOT BECAUSE OF READING THIS FORUM.
    I GUESS POS SOLUTIONS SHOULD INVESTMENT MORE TO IMPROVE THEIR SYSTEMS.

    I HAVE BEEN WITH TOWER SINCE DAY 1 AND THEIR SUPPORT IS THE BEST IN THE WORLD.

  9. I also believe it is a silly move. Wishing every luck with the proceedings. It would also be a first for a company to sue another company over blog posts in Australia.

    POS Solutions is starting to seem like old school copyright holders all over the world, unable to create new business by the way that other people are creating business, so they sue.

  11. My understanding is that they have around 600 newsagent users, maybe a shade under this now. I have written this here and put it to them directly and they have not challenged this. They publicly claim 1,100 users. I recall them saying they have over 300 pharmacy users.

    The number of customers only matters in terms of their capacity to deliver good customer service. Customer service is a key factor in bringing people to a software company and keeping them there.

  12. Will this case prove which software is better for newsagents? I do not think so. I doubt it will ever get to court because I cannot imagine POS would like to hear from former customers why they stopped using the POS software. This is a big risk they are taking.
